Activision Blizzard Sued by California

blizzard hqFollowing a two-year investigation by the California Department of Fair Employment and Housing, the state has filed a lawsuit against Activision Blizzard for fostering a "frat boy" culture in which female employees are allegedly subjected to unequal pay and sexual harassment.

As reported by Bloomberg, Activision Blizzard is being accused by the state of California of discriminating against female employees at nearly all levels of employment, including in regards to compensation, promotion, assignments, and termination. The state alleges Activision Blizzard’s leadership has failed to address any of these outstanding issues or prevent them from occurring within the workplace. The suit, filed Tuesday in the Los Angeles Superior Court, says Activision Blizzard, which is made up of about 20 percent women, assigns women, and women of color, to "lower paid and lower opportunity levels" with lower starting pay for similar work as their male counterparts.

The documents also accuse Activision Blizzard of fostering a "pervasive 'frat boy' workplace culture in the office. Male employees are said to drink "copious amounts of alcohol" as they make their way through cubicles and "often engage in inappropriate behavior toward female employees."

Male employees are said to come to work hungover, play video games during work "while delegating their responsibilities to female employees, engage in banter about their sexual encounters, talk openly about female bodies, and joke about rape."

The lawsuit also cites one particular incident where a female employee, who was already subjected to intense sexual harassment at the company, committed suicide during a work trip with a male supervisor who allegedly brought inappropriate, sexual items with him on the trip.

The lawsuit is asking for an injunction that will force Activision Blizzard to comply with workplace protections, as well as deliver unpaid wages, pay adjustments, back pay, and lost wages and benefits for female employees.

An Activision Blizzard spokesperson sent the following statement in response to the allegations:

We value diversity and strive to foster a workplace that offers inclusivity for everyone. There is no place in our company or industry, or any industry, for sexual misconduct or harassment of any kind. We take every allegation seriously and investigate all claims. In cases related to misconduct, the action was taken to address the issue.

The DFEH includes distorted, and in many cases false, descriptions of Blizzard’s past. We have been extremely cooperative with the DFEH throughout their investigation, including providing them with extensive data and ample documentation, but they refused to inform us what issues they perceived. They were required by law to adequately investigate and to have good faith discussions with us to better understand and to resolve any claims or concerns before going to litigation, but they failed to do so.

Instead, they rushed to file an inaccurate complaint, as we will demonstrate in court. We are sickened by the reprehensible conduct of the DFEH to drag into the complaint the tragic suicide of an employee whose passing has no bearing whatsoever on this case and with no regard for her grieving family. While we find this behavior to be disgraceful and unprofessional, it is, unfortunately, an example of how they have conducted themselves throughout the course of their investigation. It is this type of irresponsible behavior from unaccountable State bureaucrats that are driving many of the State’s best businesses out of California.

The picture the DFEH paints is not the Blizzard workplace of today. Over the past several years and continuing since the initial investigation started, we’ve made significant changes to address company culture and reflect more diversity within our leadership teams. We’ve updated our Code of Conduct to emphasize a strict non-retaliation focus, amplified internal programs and channels for employees to report violations, including the “ASK List” with a confidential integrity hotline, and introduced an Employee Relations team dedicated to investigating employee concerns.

We have strengthened our commitment to diversity, equity, and inclusion and combined our Employee Networks at a global level, to provide additional support. Employees must also undergo regular anti-harassment training and have done so for many years.

We put tremendous effort into creating fair and rewarding compensation packages and policies that reflect our culture and business, and we strive to pay all employees fairly for equal or substantially similar work. We take a variety of proactive steps to ensure that pay is driven by non-discriminatory factors. For example, we reward and compensate employees based on their performance, and we conduct extensive anti-discrimination training including for those who are part of the compensation process.

We are confident in our ability to demonstrate our practices as an equal opportunity employer that fosters a supportive, diverse, and inclusive workplace for our people, and we are committed to continuing this effort in the years to come. It is a shame that the DFEH did not want to engage with us on what they thought they were seeing in their investigation.

Conclusion

We will see how things work out, but I am not too optimistic for Activision Blizzard, truth to be told these reports are really bringing up some disturbing news on the sunlight. I just hope that all responsible will be brought to justice.

Step 6: In the elevated Command Prompt, type and enter the following command to execute it:
icacls FileNameAndPath /GRANT ADMINISTRATORS:F
Note: We’re going to use the wuapi.dll again as an example. So the command should be like this: icacls “C:/Windows/System32/wuapi.dll /grant administrators: F”. Step 7: Now all that’s left to do is replace the corrupted system file with a good copy from a trusted source. Once you have a copy, open an elevated Command Prompt again and execute the following command:
copy NewFileLocation FileNameAndPath
Note: In the command given above, the “NewFileLocation” is the location where you have saved the copy of the file. For instance, if you’ve saved it on your desktop, this is how it should look: “copy C:/Users/<username>/Desktop/wuapi.dll C:/windows/system32/wuapi.dll”

Option 1 – Restart your computer and try installing the Updates again

Option 2 – Delete the contents in the Software Distribution folder and Catroot2 folder

After resetting the SoftwareDistribution folder, you need to reset the Catroot2 folder to restart the services you just stopped. To do that, follow these steps:
  • Type each one of the following commands.
net start wuauserv net start cryptSvc net start bits net start msiserver
  • After that, exit Command Prompt and restart your computer, and then try to run Windows Update once more.

Option 3 – Try running the Windows Update Troubleshooter

Running the built-in Windows Update troubleshooter is one of the things you can first check out as it is known to automatically resolve any Windows Update errors like error 0x80070005. To run it, go to Settings and then select Troubleshoot from the options. From there, click on Windows Update and then click the “Run the troubleshooter” button. After that, follow the next on-screen instructions and you should be good to go.

Option 4 – Take control of the User App Data

There are times when permission to access the files is not configured correctly. As a result, it blocks the downloading of the updates. Thus, you have to take full control of the User App Data which is placed at C:/Users/USERNAME/AppData.

  • Tap Win + R to launch Run.
  • Type in cmd in the field and tap Enter.
  • After opening Command Prompt, type in sfc /scannow
The command will start a system scan which will take a few whiles before it finishes. Once it’s done, you could get the following results:
  1. Windows Resource Protection did not find any integrity violations.
  2. Windows Resource Protection found corrupt files and successfully repaired them.
  3. Windows Resource Protection found corrupt files but was unable to fix some of them.
  • Reboot your computer.

Option 3 – Try to run the Program Compatibility Troubleshooter

You might also want to run the Program Compatibility Troubleshooter. This built-in troubleshooter is available in the Windows Update & Security section. From there, select Troubleshoot. This will find a list of programs for you and since you have already downloaded the driver files, just click on Not Listed located at the top of the program list. After that, browse and select the driver files and then let the program do its job. In addition, you can try to run the Windows Store apps troubleshooter as it can also help you resolve the problem.

Option 4 – Reset your computer

  • Tap the Win key or click on the Start button located in the Taskbar.
  • Then click on the Power button at the bottom right portion of the screen.
  • Next, press and hold the Shift key on your keyboard and then click on Restart. This will restart your Pc into the Advanced Startup options.
Note: Once you have access to the Advanced Startup options, you have to go to the setting which allows you to Reset your Windows 10 PC. All you have to do is select Troubleshoot > Reset this PC to reach the following screen
  • Afterward, select either the “Keep my files” option and then proceed to the next on-screen instructions that follow to reset your Windows 10 computer without losing your files.

Once you’ve removed the external device, check it for any damages. Option 2 – Try removing hardware or drivers that you’ve installed recently

  • Tap the Win + R keys to launch the Run dialog box.
  • Then type “devmgmt.msc” in the field and tap Enter to open the Device Manager.
  • From there, look for any faulty drivers. You can identify them easily as they will be marked with a yellow exclamation point. And then check which entries would not affect the normal functioning of your PC.
  • Now click on the entries of every faulty driver and click on the Uninstall option.
  • Once you’ve uninstalled them, restart your computer to allow your computer to reinstall the faulty drivers you’ve just removed.

Option 5 – Run System File Checker at boot time

  • Once you get to the Welcome Screen part, click on Next.
  • Afterward, click on the Repair your computer option located on the bottom-left part of the window.
  • Then click on Troubleshoot.
  • Next, select the Advanced Options and then Command Prompt.
  • After opening Command Prompt, type the “sfc /scannow” command and hit Enter to run the System File Checker scan.
  • Wait until the process is completed and type “exit” to close Command Prompt and then restart your computer to successfully apply the changes made.

Option 6 – Try to run the Blue Screen Troubleshooter

As you know, the Blue Screen troubleshooter is a built-in tool in Windows 10 that helps users in fixing BSOD errors like the VIDEO_SCHEDULER_INTERNAL_ERROR error. It can be found in the Settings Troubleshooters page. To use it, refer to these steps:
  • Tap the Win + I keys to open the Settings panel.
