Following a two-year investigation by the California Department of Fair Employment and Housing, the state has filed a lawsuit against Activision Blizzard for fostering a "frat boy" culture in which female employees are allegedly subjected to unequal pay and sexual harassment. As reported by Bloomberg, Activision Blizzard is being accused by the state of California of discriminating against female employees at nearly all levels of employment, including in regards to compensation, promotion, assignments, and termination. The state alleges Activision Blizzard’s leadership has failed to address any of these outstanding issues or prevent them from occurring within the workplace. The suit, filed Tuesday in the Los Angeles Superior Court, says Activision Blizzard, which is made up of about 20 percent women, assigns women, and women of color, to "lower paid and lower opportunity levels" with lower starting pay for similar work as their male counterparts. The documents also accuse Activision Blizzard of fostering a "pervasive 'frat boy' workplace culture in the office. Male employees are said to drink "copious amounts of alcohol" as they make their way through cubicles and "often engage in inappropriate behavior toward female employees." Male employees are said to come to work hungover, play video games during work "while delegating their responsibilities to female employees, engage in banter about their sexual encounters, talk openly about female bodies, and joke about rape." The lawsuit also cites one particular incident where a female employee, who was already subjected to intense sexual harassment at the company, committed suicide during a work trip with a male supervisor who allegedly brought inappropriate, sexual items with him on the trip. The lawsuit is asking for an injunction that will force Activision Blizzard to comply with workplace protections, as well as deliver unpaid wages, pay adjustments, back pay, and lost wages and benefits for female employees.

An Activision Blizzard spokesperson sent the following statement in response to the allegations:

We value diversity and strive to foster a workplace that offers inclusivity for everyone. There is no place in our company or industry, or any industry, for sexual misconduct or harassment of any kind. We take every allegation seriously and investigate all claims. In cases related to misconduct, the action was taken to address the issue. The DFEH includes distorted, and in many cases false, descriptions of Blizzard’s past. We have been extremely cooperative with the DFEH throughout their investigation, including providing them with extensive data and ample documentation, but they refused to inform us what issues they perceived. They were required by law to adequately investigate and to have good faith discussions with us to better understand and to resolve any claims or concerns before going to litigation, but they failed to do so. Instead, they rushed to file an inaccurate complaint, as we will demonstrate in court. We are sickened by the reprehensible conduct of the DFEH to drag into the complaint the tragic suicide of an employee whose passing has no bearing whatsoever on this case and with no regard for her grieving family. While we find this behavior to be disgraceful and unprofessional, it is, unfortunately, an example of how they have conducted themselves throughout the course of their investigation. It is this type of irresponsible behavior from unaccountable State bureaucrats that are driving many of the State’s best businesses out of California. The picture the DFEH paints is not the Blizzard workplace of today. Over the past several years and continuing since the initial investigation started, we’ve made significant changes to address company culture and reflect more diversity within our leadership teams. Your Windows 10 upgrade will not be successful if you’re not able to create a user account or finish the Out of the Box (OOBE) phase of the installation. Here are some methods that will help you fix this manually.

Method 1 – Wait and retry

Some users reported that waiting for about an hour and retrying the process again will solve this problem. It’s also recommended that you keep your computer in a ventilated place while you wait to retry the process.

Method 2 – Load default user manually

This method has 2 requirements in order to work.

1. You need to be upgrading from a previous Windows version, and
2. Your Windows was originally configured to automatically boot to desktop

If you meet these two requirements, you can solve the error by following the steps below:

1. Hold CTRL+ESC keys. Windows should load the default user after doing this step.
2. Press the Windows key + X. Then, click the Computer Management icon
3. Choose “Local Users and Groups”
4. Double click on Users
5. Right-click on the right pane, and then choose “New User”
6. Create a new user account and password

Method 3 – Power down your laptop

This method only applies if you’re a laptop user.

1. Power down your laptop
2. Remove the battery of your laptop
3. Wait for about 10 minutes
4. Connect your laptop using direct current
5. Turn on your laptop again
6. Create a new user account and log in

Method 4 – Create a local account if you’re trying to set up a Microsoft account

Instead of connecting to a Microsoft Account after the set-up, you might want to try creating a local account. To do this, follow the steps below:

1. Power down your computer if you are to set up a Local Account.
2. Disconnect your computer from the Internet, either Wired or Wireless
3. Unplug your computer, and wait for about 10 minutes.
4. Reconnect your computer and start Windows. Do NOT connect to the Internet and make sure you’re disconnected to any devices you don’t need.
5. Try creating a user account again

 If the steps above don’t work, you might want to try Startup repair.

Method 5 – Boot your computer from Windows 10 media

In order to do this step, you need to have official Windows 10 ISO files.

1. Go to the “Install Now” screen
2. Choose Repair your computer
3. Click Advanced Options
4. Click Safe Mode

After doing the steps above, there’s a chance you get an error message that says “installation cannot be completed in safe mode”. When you see this, just press Shift+F10. This will execute and open the command prompt of your computer.

 From the command prompt, you can try and create a new user account.

 For example, net user Username Password /add

 The username here should be replaced with the account name you want to add, and the Password here should be replaced with the password you want to use for the account.

 After replacing the username and password on the text, press the Enter button on your keyboard. You’ll know if the command is successful once you see the message, “The command completed successfully.”

You can now close the command prompt. Restart your computer and try to log in using the account you just created.

Method 6 – Use a powerful automated software

If all the above methods still don’t work, it might be best to try automated software to help you fix this problem.

The author of the famous software library mode-ipc that gets over a million downloads per week found that it has some questionable code inside. The code itself behaves like this: if it finds out that your location is within Russia or Belarus it will try to replace the contents of all files on the computer with a heart emoji.

One important thing is that we here are not supporting the current Ukrainian situation and are against any type of violence or war but we also do not support this kind of behavior as well. If we look at this only from a technical perspective, we would then classify the mode-ipc library as malware and a harmful piece of code no matter the motivation behind it.

So this so-called protestware is well basically malware, but not always, it will protest when certain conditions are met. The issue with this is that companies and users should not be placed under harm if they do not share the personal view of the code author. Imagine if, for example, I would publish code to delete all pictures from your computer if my code found out that you do not like metal music. I guess you not liking metal music and war in Ukraine are two very different things but the source is the same, unreliable code that invades your privacy in order to serve one purpose, punishment for disagreeing with my personal views and that should not be allowed.

Not all protestware are equal, some will not harm your computer on purpose, they will just annoy you with some messages like viruses did in their infancy stages, others might place some developer sanctions but no matter the outcome basic principle is the same, it does something without user consent and without informing the user that something like that might happen.

On the internet, many blog posts and discussions were open about this issue and its morality. Discussion is still active with different takes on the situation and how to prevent it. Our take on this matter is that professional developers should have standards and not submit to doing harm for the sake of personal views and feelings.

In the long run, this kind of behavior and practice can only harm developers involved in this kind of entanglement. Infected libraries will in time stop being used since people would not trust them and authors will have a stain on their name as impulsive or not trustworthy.
